Tour Packages
This is an English translation provided for your convenience. The legally binding version is the Italian one.
These general terms and conditions of sale (hereinafter the "General Conditions") govern the offer and sale of Travel Packages available on the website www.rottediportolano.com.
(The intermediation services offered by LRDP Group Srl for the bareboat rental of vessels are subject to separate general conditions.)
PREAMBLE
In addition to the general conditions set out below, an integral part of the travel package contract is the description of the travel package contained in the catalogue (online or printed), or in the separate travel programme, as well as the booking confirmation sent by LRDP Group as agent of the traveller. In signing the proposal for the purchase and sale of a travel package, the Traveller must bear firmly in mind that, on their own behalf and on behalf of the persons indicated in the contract, it constitutes acknowledgement and acceptance of the travel package contract as governed therein, of the warnings and conditions contained therein, and of these general conditions.
Article 1 – Legal Sources
The sale of travel packages and linked travel arrangements is governed by the Tourism Code (Articles 32-51-novies), as amended by Legislative Decree 62/2018 implementing EU Directive 2015/2302 and subsequent amendments thereto, as well as by the provisions of the Civil Code on carriage and mandate and by Legislative Decree 70/2003 on electronic commerce, insofar as applicable.
Article 2 – Definitions
Travel Package
The travel package advertised by LRDP Group Srl in accordance with the definition set out in Article 33 of the Tourism Code and subsequent amendments thereto.
Linked Travel Arrangement
Travel services purchased from different professionals under separate contracts but connected to one another for the purposes of the same trip or holiday.

Traveller
Any person who enters into a contract or intends to do so, or who is entitled to travel on the basis of a travel package or linked travel arrangement offered by LRDP Group.
Unavoidable and Extraordinary Circumstances
A situation beyond the control of the party invoking such a situation, the consequences of which could not have been avoided even if all reasonable measures had been taken.
Article 3 – Subject Matter and Scope of Application
These general terms and conditions of sale govern the offer and sale of "Travel services/packages" on the website www.rottediportolano.com.
Important guarantee: The Travel Package Contract is covered by a guarantee for the refund of the price paid and the immediate repatriation of the Traveller in the event of insolvency or bankruptcy. LRDP Group S.r.l. has taken out insolvency-risk policy no. 6006003114/U with Nobis Compagnia di Assicurazione.
Article 4 – Information to the Traveller
Before the conclusion of the Contract, LRDP Group will provide the Traveller with the Standard Information Form and the following information:
- Main characteristics of the Travel Services (destination, itinerary, periods of stay)
- Means, characteristics and categories of transport
- Location and characteristics of the accommodation
- Meals provided, if any
- Visits and excursions included
- Language in which the services are provided
- Suitability for persons with reduced mobility
- Total price inclusive of taxes and additional costs
- Payment terms
- Requirements regarding passports, visas and health formalities
- Information on insurance cover
Article 5 – Booking
The descriptive sheets of the Travel Packages are available on the Site. The booking procedure involves the following steps:
- The Traveller submits a request for a quotation to LRDP Group
- LRDP Group sends a quotation setting out the services offered and the price
- Once the deposit has been received, LRDP Group confirms the booking
- The Contract is concluded once the Traveller has made the required payment

Article 6 – Payment
Payment terms:
- Payment must be made in accordance with the terms agreed in the Booking Confirmation
- The balance must be paid at the latest 45 days before the departure date
- For bookings made within 45 days of departure, the entire amount must be paid upon signing
- Failure to pay the balance amounts to cancellation of the booking
Article 7 – Price and Price Revision
The price may be varied only as a consequence of:
- Variations in the cost of fuel or other sources of energy
- Variations in duties and taxes on the travel services
- Variations in exchange rates
Important: A price increase is possible only with notice given at least 20 days before the start of the package. If the increase exceeds 8% of the price, the Traveller may withdraw without penalty.
Article 8 – Modification, Withdrawal or Cancellation before Departure
LRDP Group may modify or cancel the package in the following circumstances:
- Insignificant changes (with notice to the Traveller)
- Significant changes or a price increase exceeding 8% (the Traveller may withdraw without penalty)
- Failure to reach the minimum number of participants (notice within 20 days of departure)
- Unavoidable and extraordinary circumstances
In the event of withdrawal, LRDP Group will refund all payments within 14 days.
Article 9 – Withdrawal by the Traveller

Cancellation penalties:
- The Traveller may withdraw at any time before departure
- The penalties depend on the destination and the time of withdrawal
- Cancellation less than 45 days before departure: penalty equal to the full price
- Failure to show up at departure amounts to cancellation on the day of departure
It is advisable to take out insurance covering withdrawal expenses.
Article 10 – Changes after Departure
If, during the trip, it becomes impossible to provide a substantial part of the services:
- LRDP Group offers suitable alternative arrangements at no additional charge
- If the alternatives are of lower quality, a price reduction is granted
- The Traveller may reject the alternatives if they are not comparable
- If repatriation is impossible, LRDP Group bears the cost of accommodation (max. 3 nights)
Article 11 – Substitution and Transfer of the Contract
The Traveller may transfer the contract to another person provided that:
- LRDP Group is informed at least 7 days before departure
- The substitute person meets all the requirements (passport, visas, etc.)
- The administrative costs for the substitution are paid (€ 80.00 per change)
The transferor and the transferee are jointly and severally liable for payment.
Article 12 – Obligations of Travellers
Important: Travellers must independently verify with the competent authorities that their documents are in order. For Italian citizens: www.viaggiaresicuri.it
Main obligations:
- Hold valid documents (passport, visas, health certificates)
- Inform LRDP Group of their nationality before booking
- Check the security conditions of the country of destination
- Promptly communicate any specific needs
- Comply with the rules of ordinary prudence and diligence
Article 13 – Hotel Classification
The official classification of hotel facilities is provided on the basis of the indications of the competent authorities of the country in which the service is supplied.
Article 14 – Liability for Improper Performance
LRDP Group is responsible for the performance of all the Travel Services provided for in the Contract.
In the event of defects:
- The Traveller must inform LRDP Group promptly
- LRDP Group remedies the defect within a reasonable period
- If this is impossible, the Traveller may terminate the contract
- If repatriation is impossible, LRDP Group bears the cost of accommodation (max. 3 nights)
Article 15 – Price Reduction and Compensation for Damages
The Traveller is entitled to:
- A price reduction for the period of lack of conformity
- Adequate compensation for the damages suffered
Exceptions: No compensation is granted if the defect is attributable to the Traveller, to unrelated third parties, or to unavoidable and extraordinary circumstances.
Article 16 – Duty to Provide Assistance
LRDP Group provides appropriate assistance to the Traveller in difficulty, supplying information on health services, local authorities and consular assistance.
Article 18 – Insurance
The Traveller undertakes to take out insurance policies covering withdrawal expenses, accidents, illness and repatriation. Such rights must be exercised directly with the insurance companies.
Article 19 – Guarantees for the Traveller
LRDP Group is insured for civil liability and guarantees the refund of the price and immediate repatriation in the event of insolvency or bankruptcy through policy no. 6006003114/U with Nobis Compagnia di Assicurazione.
Article 21 – Mandatory Notice (Law no. 38/2006)
Italian law punishes with imprisonment offences concerning child prostitution and child pornography, even when committed abroad.
Article 22 – Privacy
The processing of personal data will be carried out in accordance with EU Regulation 2016/679 (GDPR). For more information, please consult the privacy policy.
Article 23 – Applicable Law and Jurisdiction
The contracts are governed by Italian law, with the application of the provisions of:
- The Consumer Code (Legislative Decree 206/2005)
- Legislative Decree no. 70/2003 (electronic commerce)
- The Tourism Code (Legislative Decree 79/2011)
For any dispute, jurisdiction lies with the Court of the place where the user resides or has elected domicile, if located within the territory of the Italian State.
